Your personal data will only be collected, processed and used by solebox | MBCY in accordance with the applicable data protection law. Our data protection practice is thus consistent with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG-neu)

Personal data means any information relating to an identified or identifiable natural person; a natural person is considered as being identifiable, directly or indirectly, in particular by means of an identifier such as a name, an identification number, location data, an online identifier or one or more special characteristics expressing the physical, physiological, genetic, mental, economic, cultural or social identity of this natural person can be identified (Article 4 No. 1 GDPR). This includes, for example, your name, your telephone number, your address and all inventory data that you provide us with when registering and creating your customer account. Statistical data or anonymized data, which we collect, for example, when visiting our web shop and which can not be directly associated with your person, are not covered here.

  1. Collection, processing and use of your personal data

    You can visit our website without having to reveal any of your personal details. We only store access data which does not reveal any links to a given person. This data will only be used to improve our offer. We will not use the data to draw any conclusions about the users who visit our website

  3. Use of Google Analytics

    If you give us your consent, we will use the Google Analytics service provided by Google Ireland Limited ("Google"). We comply with the current Google Analytics Terms of Use and the Google Ads Data Processing Terms and, if your personal data is processed in an insecure third country, we have signed the standard contractual clauses approved by the EU Commission with Google LLC in accordance with Art. 46 paragraph 2 lit. c) DSGVO, Information here. According to Section 10.3 Google Ads Data Processing Terms the information you provide will be stored at the following locations (so-called „data center locations“): www.google.com/about/datacenters/locations/.
    For this reason, we will only use Google Analytics if you also consent to the transfer to the data centers listed above. In some cases, the third countries in which the data centers are located or from which processing is carried out do not provide an adequate level of data protection, based on a decision by the European Commission (see a list of so-called safe third countries here: ec.europa.eu/info/law/law-topic/data-protection/international-dimension-data-protection/adequacy-decisions_de). For example, the USA is currently not considered a safe third country. The transfer to unsafe third countries is associated with risks for your personal data, especially since access by the US authorities cannot be ruled out in the event of a transfer to the USA.     If you have consented to its use, we use the web analytics service Google Analytics. Google Analytics collects pseudonymous information about your use of our website, including your shortened IP address and the use of cookies. The information generated by the cookie about your use of the website (including your shortened IP address) will be transmitted to and stored by Google on servers in the countries listed above.   4. Data protection and use of Facebook

    This website uses plugins from the social network facebook.com operated by Facebook Inc., 1601 S. California Ave., Palo Alto, CA 94304, USA ("Facebook").

    If you visit our internet presence with such a plugin, a connection to the Facebook servers will be established and the plugin will be displayed on the website by a message to your browser. This will be transmitted to the Facebook server, which of our websites you have visited. If you are logged in as a member of Facebook, Facebook assigns this information to your personal Facebook user account. When using the plugin functions (for example, clicking on the "Like" button, submitting a comment) this information will also be assigned to your Facebook account.     We have no influence on the amount of data that Facebook collects with the help of this plugin and therefore inform you according to our knowledge.     When using Facebook technically necessary data of the user are transmitted to Facebook. All activities that the user performs within the Facebook portal are visible and traceable for Facebook.

     

  5. Transfer of personal data

    An encrypted transfer of your data will be made to the shipping company commissioned with the delivery of the goods. To process payments, we pass on your payment details to the bank responsible for the payment. For personalized advertising, we share some of your voluntary information with our newsletter service provider. 

     

  6. Re-targeting and use of the service Criteo

    Our website uses cookies / advertising IDs for advertising purposes. This allows us to show our advertisements to visitors who are interested in our products on affiliate websites, apps and emails. Re-targeting technologies use cookies or promotional IDs and display advertising based on your previous browsing behavior.   7. Use of tracking pixels

    Tracking pixels have very similar functions to cookies, but they are not noticeable to the user. We use tracking pixels within our online shop to track the user behaviour and to control the offers our re-marketing mix. This data is completely anonymous and it is not linked to the personal data on a user's computer or to a database. To prevent web bugs attacking our pages, you can use tools such as webwasher, bugnosys or AdBlock (for Chrome or Firefox). To prevent web bugs in our newsletter, please set your mail program so that no HTML is displayed in messages. Web bugs are also prevented when you read your e-mails offline.

    We process your personal data when you subscribe to the solebox | MBCY newsletter. In particular, this may include the following data:

    • Data we receive when we participate in a raffle organised by us (details of the competition, answers)

    • Information we receive when you register an account on our website, solebox.com or mbcy.com, (title, first name, last name, email address, zip code, date of registration, date of the last log in)

    • Information about your online purchases from solebox | MBCY (goods/services, payment amount, currency, location, discount amount)

    • Data we receive when redeeming vouchers or coupons and activating credit (redeemed vouchers and coupons from solebox | MBCY, date and place of redemption)

    • Information collected when you use the solebox.com or mbcy.com website (pages viewed, services used, wish list, preferences)

    • Data that we receive when using customer surveys (survey results)

    • Data that we generate on the basis of the evaluation of the aforementioned data (customer segments, assumed product preferences)


    We only process the above-mentioned data to the extent that we actually receive them. For example, when using our website features, placing an order on solebox.com or mbcy.com or participating in one of our raffles.

    Direct mail: We use your e-mail address to send you the solebox | MBCY newsletter on products, offers, services, promotions, satisfaction surveys.

    The legal basis for the described data processing is Art. 6 para. 1 (a) of the GDPR (consent).

     

    Personalisation of the newsletter content

    We want to provide you with advertising that is geared to your individual interests. To this end, we analyse your data and try to select products, services and promotions that suit you when designing the newsletter. The above-mentioned data helps us to identify typical patterns of purchasing behaviour, clearly define target groups and tailor the advertising to the respective target group. Calculated purchase probabilities help us to identify your needs better. In addition, your data enables us to display selected offers, adjust the frequency of the solebox | MBCY newsletter to your usage habits and address you personally with your name. The legal basis for the described data processing is Art. 6 para. 1 (a) of the GDPR (consent).

     

    Advertising success monitoring

    We evaluate the results of our marketing activities to measure the efficiency and relevance of our campaigns. We assess the success of our advertising activities in order to continuously improve our marketing activities in your interest and plan new measures. The legal basis for the described data processing is Art. 6 para. 1 (f) of the GDPR (balancing of interests based on our interest in measuring the success of advertising measures). To personalise our website and newsletter content, we create user profiles using the Emarsys Marketing Cloud. For this purpose, all data collected with the Emarsys Web Extend database, both by JavaScript commands and by cookies, are stored either anonymously (before login) or pseudonymised (after login).

    For visitors with newsletter registration, our website also uses JavaScript commands to collect browsing and purchasing information. This data is used to enrich your customer profile and to provide you with a personalized experience at all our contact points. You can directly Opt-Out of this profile enrichment or contact our customer support .

    If you do not object, your personal data will be stored and updated as long as you are subscribed to our newsletter. When you unsubscribe the newsletter, we will stop sending it to you and delete your data as long as we are not entitled to store it for certain purposes, including the defence against legal claims, due to legal reasons.

    The legal basis for data processing is Art. 6 para. 1 (f) of the GDPR. Our legitimate interests consist of the aforementioned purposes.

    We process your data automatically with the intent of evaluating certain personal aspects (profiling). For example, we analyse your data using mathematical-statistical methods to tailor advertising to your individual interests.

    Within solebox | MBCY, only people who need to know your information to perform the tasks assigned to them are granted access to your data. Outside of solebox | MBCY, we may provide access to your information to service providers who assist us in fulfilling our functions. These are, for example, service providers that we have commissioned to operate our servers, send out newsletters, or perform data analysis. These service providers must meet specific confidentiality requirements. They are only granted access to your data to the extent and for the period necessary to perform their tasks.

    Countries outside the European Union handle the protection of personal data differently from EU member states. We also use service providers located in third countries outside the European Union to process your data. There is currently no EU Commission resolution that these third countries generally offer an adequate level of protection. Therefore, we have taken special measures to ensure that your data is processed just as securely in the third countries as within the European Union. With service providers in third countries, we conclude the data protection agreement (standard data protection clauses) provided by the Commission of the European Union for the processing of personal data in third countries. This contract provides for appropriate safeguards for the protection of your data with service providers in the third country.

    We store your data as long as you have subscribed to the solebox | MBCY newsletter. Once you unsubscribe it, your data will be deleted unless we are entitled by law to store it for specific purposes, including defence against legal claims. In the event of an objection, we will no longer process your data, unless we can prove compelling reasons for processing worthy of protection that outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

    You are entitled to issue a complaint with the competent data protection authority if you do not agree with the processing of your data.

     

    Data portability

    You have the right to receive personal information that you have provided us electronically.

     

    Revocation of your consent

    You have the right to revoke your consent to receive the solebox | MBCY newsletter and to have your data processed at any time. This also applies to the revocation of any declarations of consent you may have made to us prior to the validity of the GDPR, i.e., prior to 25 May 2018. The easiest way to revoke your consent is to click on the unsubscribe link found in every e-mail. The revocation of your consent does not affect the legality of the processing of your data carried out up to the revocation.

  9. Awin

    Sole Brothers GmbH processes your personal data in order to operate affiliate marketing campaigns. This enables us to understand which third party operators of websites, apps and other technology have referred potential customers to our websites and apps and allows us to pay them a commission in return for those referrals. We do this in the pursuit of our legitimate interests of carrying on an online advertising campaign, paid for on a performance basis. We work with Awin, which helps us to carry out these affiliate marketing campaigns. You can find the Awin privacy policy here, which includes information on your rights in respect of their data processing.

    In some instances, Awin may maintain a limited profile which relates to you, but which does not reveal your identity, online behaviour or other personal characteristics. This profile is only used to understand whether a referral is commenced on one device and completed on another device.

    In some cases, Awin and the referrers of potential customers may receive and process your personal data for the purposes of carrying out affiliate marketing campaigns with us. We also receive personal data from Awin and the referrers of potential customers, which can be categorised as: cookie data, data relating to the website, app or other technology from which a potential customer was referred and technical information relating to your device or an ID individually assigned to your transaction, which Awin can assign to the aforementioned data in its system.

    • The DHL package announcement, which can be actively selected during the ordering process, does not require any revocation, as it will only be used once by DHL and not for advertising purposes.

    • Processing of online purchases, evaluation of the click and purchase behavior of customers as well as (personalized) marketing as described in detail above

    • Analysis of Click and Purchase Behavior, Email Tracking and Personalized Marketing: We will evaluate your shopping history for products you have already purchased to offer suggestions on other similar products.     You have a right to information on the part of the person responsible about the relevant personal data (Article 15 GDPR) as well as to rectification (Article 16 GDPR) or cancellation (Article 17 GDPR) or to restriction of processing (Article 18 GDPR) or Data transferability (Art. 20 GDPR) and a right to object to processing (Art. 21 GDPR).     If the data processing is based solely on Art. 6 (1) (a) GDPR, i.   15. Use of Kameleoon

    This website uses the test and web analysis service Kameleoon. The software tool enables an analysis of user behavior based on user segmentation. By evaluating the logfile data, Kameleoon can determine how individual user segments are visiting the website, which landing pages are visited and how click rates can be increased. As described above, cookies and or the local storage of the browser are used for the analyses, which are linked to a pseudonymised ID. Your IP address is completely anonymized and not stored. The information generated by the cookie/local storage about your use of this website is transmitted to a Kameleoon server in Germany and stored there in aggregated and pseudonymised form. The IP address transmitted by your browser within the framework of Kameleoon is not merged with any other Kameleoon data. The use of Kameleoon serves the purpose of evaluating your use of the website and compiling reports on website activity so that we can regularly improve our services. The legal basis for the storage of cookies is the consent given (Art. 6 Para. 1 S. 1 lit. a DS-GVO). The further evaluation of the collected data takes place over a period of max. 365 days on the base of Art. 6 Para. 1 S. 1 lit. f DS-GVO.     Customer Service Automation is carried out with the support of the third-party provider DigitalGenius, 110 Clifton Street, London EC2A 4HT, UK. As part of this process, DigitalGenius processes personal data in order to process the request. All data is stored on the platform for 30 days only.
